Terms of Service

Welcome to Showcase. These Terms of Service ("Terms") govern your use of the Showcase mobile application (the "App") operated by Village Home Cleaning LLC, doing business as Serviche ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials confidential and secure
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain inaccurate information.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload, post, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Upload photos containing illegal content or content that violates the rights of others
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the App or servers or networks connected to the App
• Attempt to gain unauthorized access to any part of the App or any other systems or networks
• Use the App to transmit any viruses, malware, or other malicious code
• Use the App for any commercial purpose not expressly permitted by us
• Scrape, data mine, or use automated systems to access the App without our permission
• Circumvent, disable, or otherwise interfere with security features of the App

User Content

The App allows you to upload, store, and share photos and other content ("User Content"). You retain ownership of your User Content. However, by uploading User Content to the App, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store, process, and display your User Content as necessary to provide the App services
• Create backups for disaster recovery purposes
• Share your User Content with team members within your organization as configured by you
• Display published photos on public gallery pages and embeddable widgets

You represent and warrant that:

• You own or have the necessary rights to upload your User Content
• Your User Content does not infringe any third-party intellectual property rights
• You have obtained necessary consents from individuals depicted in your photos
• Your User Content complies with all applicable laws and regulations

Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by Village Home Cleaning LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the App, unless permitted by law or with our written consent.

Subscriptions and Payments

Some features of the App require a paid subscription. By purchasing a subscription:

• You agree to pay all fees associated with your selected subscription plan
• Subscriptions automatically renew unless canceled before the renewal date
• Prices may change with notice; continued use after a price change constitutes acceptance
• Refunds are handled according to the policies of the app store through which you subscribed

Payment processing is handled by Stripe. By making a purchase, you also agree to Stripe's terms of service.

Team and Organization Features

If you create or join a team/organization within the App:

• Organization administrators have control over team member access and permissions
• Photos uploaded by team members are accessible to other team members based on permissions
• Organization administrators may remove team members and their access to shared content
• When you leave an organization, you may lose access to photos uploaded during your membership

Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in our Privacy Policy.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE APP

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VILLAGE HOME CLEANING LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT
• DAMAGES RESULTING FROM ANY INTERRUPTION OR CESSATION OF THE APP
• DAMAGES RESULTING FROM ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Village Home Cleaning LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of a third party
• Your User Content

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and User Content
• Provisions of these Terms that by their nature should survive termination will survive

You may terminate your account at any time by contacting us or using the account deletion feature in the App.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Florida.

Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue legal remedies in the courts of Florida.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. For significant changes, we will provide notice through the App or via email.

Your continued use of the App after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you should discontinue use of the App.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Village Home Cleaning LLC regarding the use of the App and supersede any prior agreements or understandings.
